HANDLING REAL ESTATE DISPUTES
Disputes over a real estate transaction can be stressful and unnerving.
There are three (3) basic types of disputes in real estate. Arbitrations are complaints regarding money, while ethical violations are those in which the REALTOR Code of Ethics is in question, and the last is a legally complex issue that would require a judicial court.
Remember, not all real estate agents are REALTORS. For the REALTOR association to intervene, the real estate agent must be a member. Otherwise, the dispute would need to be handled in a court of law.
It is always advisable to seek counsel if you have a dispute regarding a real estate transaction, for your protection.
WHAT WE SUGGEST…..
CONTACT AN OMBUDSMAN FIRST
The primary duty of an ombud is to work with individuals to explore and assist them in determining options to help resolve conflicts, problematic issues or concerns. Click here to use the Tennessee Ombudsman Program.
ATTEMPT RESOLUTION WITH THE BROKER
FOR ARBITRATION CASES, CONSIDER MEDIATION
After you have attempted to contract the broker, with no resolution, consider that it is faster, less expensive and everyone can agree to the terms of a resolution by using mediation services. Mediation will be offered to parties during the arbitration request. Mediation is encouraged as a useful tool for resolving disputes and conflicts. To file a mediation request or to file an arbitration, please use this link Tennessee Association of REALTORS.
