HOW THE ASSOCIATION AND MLS GOVERNED
Leadership at the River Counties Association of REALTORS and the RC-MLS is completely voluntary. We use a system of Committees, Task Forces and Presidential Advisory Groups, (known as PAGS), to work through projects, policy and procedures in order for the Board of Directors to make educated decisions on behalf of the Members on the Associations side and Participants and/or Subscribers for the MLS side.
The RCAR Board of Directors and the RC-MLS Board of Directors are all volunteers, with a desire to assist and direct the future of the Association and/or the MLS.
Typically you should have served on a committee to run for a director position, so you have experienced the procedures of Robert’s Rules of Procedures. However, if you have a specific talent, or experiences on other Boards, this requirement can be waived.
COMMITTEES, TASK FORCE & PAGS
We are always recruiting members to our committees, which include the MLS Advisory Group (Rules are defined in the MLS Rules & Regulations) the REALTOR Action Committee, Member Services Committee, Community Outreach Committee and the Cultural Diversity Committee. EXPECTATIONS OF RCAR DIRECTORS
We work hard to use your time wisely and attempt to keep all committee and BOD Meetings to 1 hour monthly. You would be expected to attend regular monthly BOD meetings, where you would give input and vote on board policies, procedures and budgetary reviews.
In addition, we ask that you participate in association events, and support Association/MLS decisions as a team and to relay policy and issues facing our RCAR members through your office meetings.
When serving as an Executive Committee member, which is one of the 5 officers (President, President-Elect, Treasurer, Secretary and Past President) positions, attendance a the monthly Finance Committee meeting is required.
Travel increases during your years at the level of President and President-Elect (on both the Association and the MLS sides), attending the TENEX in April (Nashville); NAR Legislative Week in May (D.C.); NAR Leadership Training in August for 2 days (typically in Chicago); TAR Convention in September (typically in TN); and NAR Convention in November (moves annually).
You must have served on a Committee prior to applying for a Board position pursuant to the Bylaws.
MLS BOD DIRECTORS
Members on both the RCAR BOD and THE RC-MLS BOD serve staggered terms of 3 year terms and then can also move into the position of an officer, should their schedules permit.
Only Managing Brokers can serve as directors and only Primary Brokers can serve as officers on the MLS BOD. There are 2 at-large director positions for subscribers. When those come up for election any primary MEMBER subscriber can apply.
You must have served on a Committee prior to applying for a Board position pursuant to the Bylaws.
APPLICATIONS FOR DIRECTOR POSITIONS
Nominations typically open in early August and are due by August 15, at which time the nominating committee will review and select candidates for the slate, which is typically announced the first week of September.
ELECTIONS PROCEDURES
RCAR Online elections are held the 1st Tuesday and Wednesday of October, with an installation held at the annual gala in December.
RC-MLS elections are held in person at the Fall Participant’s Meeting, on the 1st Wednesday in October annually, also installed at the Gala in December.
RCAR BYLAWS REGARDING ELECTIONS
Section 4. Election of Officers and Directors.
(a) At least two (2) months before the annual election, a Nominating Committee of five (5) REALTOR® Members shall be appointed by the President with the approval of the Board of Directors.
The Nominating Committee shall select at least one candidate for each place to be filled on the Board of Directors. shall be mailed or where permitted by state law, electronically transmitted to each Member eligible to vote at least three (3) weeks preceding the election.
Additional qualified candidates for the offices to be filled may be placed in nomination by petition signed by at least 10% of the REALTOR® Members eligible to vote. The petition shall be filed with the Association Executive Officer at least two (2) weeks before the election. The Chief Executive Officer shall send notice of such additional nominations to all members eligible to vote before the election. (Amended 1/05) (Amended 6/08) Amended 9/12)
(b) The election of Officers and Directors shall take place at the annual meeting or where permitted by state law, electronically. (Amended 01/05) Where permitted by state law, and in accordance with applicable state requirements, election of officers may be conducted by electronic means, in accordance with procedures established by the board of directors. (c) The President, with the approval of the Board of Directors, shall appoint an Election Committee of at least three (3) REALTOR® Members to conduct the election. In case of a tie vote, the issue shall be determined by a runoff election.
RCMLS BYLAWS REGARDING ELECTIONS
6.3 Nomination and Election of Officers and Directors: The Officers and Directors of the Service shall be nominated by a vote of the Participants in the Service in accordance with the provisions of Article 7, Meetings, of these bylaws and as set forth below.
- Nominating Committee: The President of the Service shall appoint a Nominating Committee each year which Committee shall be comprised of five (5) Participants of the Service. The appointment of the Nominating Committee shall be made by such a date as to enable the Committee to meet and select a proposed slate of Officers and Directors of the Service not more than 60 days nor less than 45 days prior to the date of the meeting of the Participants of the Service which nominees shall be selected by vote of the Participants. The proposed slate of Officers and Directors shall be reported to the President and Secretary of the Service.
- Notice of Proposed Nominees: The President shall cause a list of the proposed nominees selected by the Nominating Committee to be forwarded to the Participants of the Service, setting forth the time, place, and other pertinent conditions of the meeting to select the final list of nominees by vote of the Participants of the Service. The notice to the Participants of the Service concerning the meeting to select nominees for Officers and Directors shall be mailed on a date at least 21 days to the proposed meeting.
- Rights of Participants to Select Additional Nominees: The names of additional proposed nominees may be added to the list selected by the Nominating Committee by a petition submitted to the Secretary of the Service by 20% of the Participants of the Service, with said petition received not less than 14 days prior to the date of the meeting of the Participants to select nominees for Officers and Directors. The names contained in such petition, if duly received and certified, shall be presented in writing to the Participants at the meeting to select nominees as additional nominees for consideration for such office as specified in the petition. In addition, nominations may be made from the floor at the duly noticed meeting of the Participants to select nominees for Officers and Directors and, if seconded, shall be added to the list of proposed nominees.
